Some questions
IANAL, but in the capital case, yes for several reasons:
he may not have been sentenced to death in the 2nd case;
the jury may not have sentenced the real murderer to death in the 1st case since there are obviously different circumstances involved;
presumably there was evidence he committed the 1st murder as well. Just because there is evidence he committed the 2nd murder doesn’t mean...

I just got around to watching this on the DVR: Letterman does a GREAT job of interviewing him… John Stewart couldn’t have done it better. Manages to hold his feet to the fire at the same time he pokes fun at his hair and his other personal absurdities.
